If you’re a retailer who accepts EBT at your retail store, then you might have gotten a official notice from the USDA. The notification is most likely a SNAP violation notice, which is alleging you are in violation of the SNAP program. The USDA will attach a number of pages to the SNAP violation notice, and it will contain records of transactions that occurred at your store which the government claims violates one or more categories of violations.

The first thing after you get a SNAP violation notice, you must speak to our our law firm. Remember, you have only ten days to respond to the letter. If you don’t respond, the government will suspend your stores ability to take EBT.

About The Program

The SNAP program helps families with get food each month. These benefits are distributed to consumers with an EBT card. The SNAP benefits on the EBT card are not for general usage, and they can’t be used for cash back services. The cards took the place of food stamps in the 1990’s and are issued by each state individually where the consumer lives. The SNAP program is run on a national level by the government.

The SNAP program and the benefits that come with it are governed by the United States Code and the Code of Federal Regulations. The USDA FNS agency enforces the regulations and runs the program.

What counts as a SNAP violation

Snap violations occur when a retail store violates any of the rules below.

The retail store took part intrafficking SNAP benefits. Examples of this is fraudulently accepting the benefits, or stealing the benefits. The grocery store accepted SNAP funds in exchange for nonfood items like alcohol, tobacco, or other goods. The store submitted false info on your store’s application to accept EBT benefits. Your grocery store redeemed more EBT food stamps than food sales over the same period. Your employees accepted SNAP benefits from an unauthorized person who isn’t allowed to use the benefits.

As a grocery store retailer, there are many laws which you have to adhere to for EBT. In most normal situations, many retail store owners don’t run into problems. However, USDA’s SNAP program can be tricky. SNAP handles the Electronic Benefits Transfer Card, and has limitations. For example, SNAP recipients cant purchase electronic goods. If you violate the laws, you’ll get a SNAP violation letter. Snap violation penalties can result in severe and business crushing penalties. If you conduct a serious SNAP violation, then you might end up with either a permanent or temporary disqualification. In most cases, store owners don’t know the violations were even happening. Often, dishonest employees who are misusing the SNAP EBT program. It’s helpful to discuss your case with a SNAP violation attorney to make sure you don’t have your benefits revoked.

When a charge letter is presented to your grocery store, you only have ten days to respond to the violations. Your failure to respond will permanently crush your store. Any involvement of the management can lead to disqualification.

We highly recommend any owner that receives a letter consult with a SNAP violation attorney. Failure can result in negative consequences. The USDA is required by Congress to issue a disqualification for a period of up to 5 years. This can result in huge losses which are hard to recover from.
