If you’re a retailer who accepts EBT at your grocery store, then it’s possible have received a notice from the USDA. This notification is probably a SNAP violation letter, which is stating you have violated the SNAP program. The USDA will attach a number of pages to the SNAP violation letter, and it will have records of transactions which occurred at your retail store that the government claims is in violation of one or more groups of violations.

After you get a SNAP violation notice, you should definitely speak to our our law firm. It’s critical you understand, you only have 10 days to respond. If you choose to ignore, the USDA will terminate/suspend your grocery store’s ability to accept EBT.

About The Program

The SNAP program helps families with funds to buy food each month. The SNAP program benefits are distributed with an EBT card. The SNAP benefits on the card cannot be used for general use, and they cannot be used for cash back services. The cards took the place of food stamps in the 1990’s and the card is issued by each state individually where the recipient lives. The program is operated on a national level by the government.

The SNAP program and the benefits that come with it are governed by the US Code and the Code of Federal Regulations. The USDA FNS agency enforces the regulations and runs the program.

What does it mean to have a SNAP violation

Snap violations occur if and when a grocery store is in violation of the rules below.

The store was involved inthe trafficking of SNAP benefits. This can mean fraudulently accepting the benefits, or stealing the benefits. The grocery store accepted SNAP funds in exchange for nonfood items like alcohol, tobacco, or other goods. Your store submitted false information on your retail stores application to accept EBT benefits. Your grocery store redeemed more coupons than sale of actual food at the same time. Your employees have taken SNAP benefits from someone who isn’t eligible to use the benefits.

How we can help defend you against a SNAP violation notice

Our law firm has immense experience handling SNAP appeals letters. We can handle your SNAP violation process in all 3 phases of a SNAP violation action.

Sending the letter is the initial step taken by the USDA to remove your EBT license. This comes with, or without, prior warnings can come at any time. The violation letter has a variety of allegations, but most letters will outline violations, with an attachment of details. You have only 10 days to respond. Once you hire Spodek Law Group, our lawyers handle all of the communicationswith the USDA and for compiling all the necessary evidence, and drafting a response to the USDA.

Once the USDA reviews your answer to the violation letter, the USDA might still feel that your store has violated the rules. If this happens, the USDA will definitely send a second letter that specifically states their decision to suspend or disqualify the retail store based on the accusations previously mentioned. You have 10 days to appeal this. If you don’t, then you’ll be unable to protest the USDA decision. After you hire our law firm, we’ll file the necessary paperwork to notify the USDA appeal the decision. We’ll collect necessary evidence, and we will draft draft the necessary appeals briefs containing all of the legal laws, legal evidence, etc. which is necessary to overturn the decision.

In the event the USDA refuses to override the violation claim, in the Administrative Review, our lawyers will file a Judicial review at the local Federal District Court. This next phase is like a normal federal court case, where you’ll be able to do discovery, file motions, and have a trial. Our attorneys can handle these cases in all 50 states.

SNAP Violations

As a food store retailer, there are many laws which you have to adhere to for EBT. In most normal situations, many retail store owners have no problems adhering to them. However, the SNAP program can be tricky. SNAP handles the Electronic Benefits Transfer Card, and has limits on how the funds can be used. For example, SNAP recipients cant get electronic goods. If, and when, you violate the laws, you’ll get a SNAP violation letter. Penalties of violating SNAP can result in severe and business crushing penalties. If it’s believed you did a serious violation, then you may end up with either a permanent or temporary disqualification. In many situations, owners of grocery stores didn’t even know the violations are even occurring. Often, dishonest employees who are misusing the SNAP program. If you’re accused of a SNAP violation to discuss your case with a SNAP violation appeals lawyer to ensure sure you don’t have your benefits revoked.

When a charge letter is sent to your grocery store, you only have 10 days to respond to the violations. Failure to respond to the allegations will permanently harm your store. If you don’t respond the USDA will deliver a verdict even though you choose not to respond to the allegations. In the absence of a SNAP violation attorney, you cannot defend your store. Retaining a SNAP violation lawyer gives you a fighting change. Our SNAP appeals lawyers can challenge the findings of the USDA and fight any decision. The fines imposed can expensive - to the tune of ten’s of thousands of dollars. The USDA on purpose does huge fines to curb violations. The USDA look to see if you have a store compliance policy. It must be in writing at the store and the policy must be when the violations were filed.

The grocery store must be able to prove the above mentioned policy was in existence before the allegations, and was not drafted after the violation letter. The USDA will also look to check if the owners benefited in any way from the fraud, or were aware of the violation. If the management was involved it can lead to disqualification.

It’s highly recommended any store that gets a allegation letter speak to with a SNAP violation attorney. Failure can result in negative consequences. The USDA is required by Congress to issue a disqualification for a period of up to 5 years. This can result in huge losses which are hard to recover from.
