If you’re a retailer who accepts EBT at your retail store, then you might have gotten a letter of warning from the USDA. This letter is probably a SNAP violation notice, which is stating you have violated the SNAP program. The USDA will attach a number of pages to the SNAP violation letter, and it will have records of transactions which occurred at your store which the government claims is in violation of one or more genres of violations.

After you get a SNAP violation notice, you should contact our legal team. It’s critical you understand, you only have 10 days to respond. If you choose to ignore, the USDA will suspend your stores ability to accept EBT.

About The SNAP Program

This program helps families with funds to buy food each month. These benefits are distributed to consumers through an EBT card. The benefits on the card cannot legally be used for general usage, and they can’t be used for fraudulent cash back services. The EBT cards took the place of food stamps in the 1990’s and the card is issued by each state individually where the recipient lives. The SNAP program is run on a national level by the federal government.

The SNAP government and it’s parameters are under handled by the United States Code and the Code of Federal Regulations. The USDA FNS agency enforces the regulations and runs the program.

What does it mean to have a SNAP violation

SNAP legal violations happen if and when a grocery store is in violation of the following rules.

The retail store was involved intrafficking SNAP benefits. Examples of this is fraudulently accepting the benefits, or theft of the benefits. The retail store accepted SNAP funds in exchange for nonfood items like alcohol, tobacco, or other goods. Your store submitted incorrect info on the retail stores application to accept EBT benefits. Your grocery store took money for more EBT food stamps than actual food sales at the same time. Your employees took SNAP benefits from an unauthorized person who isn’t allowed to use the benefits.

Defending against a SNAP Violation Letter

SNAP Violations

As a grocery store retailer, there’s a lot of rules and regulations have to obey in order to accept EBT. In most cases, many grocery store owners don’t run into problems. However, SNAP can be tricky. SNAP handles the Electronic Benefits Transfer Card, and has limitations. For example, SNAP recipients cant purchase electronic goods. If you violate the laws, you’ll probably get a SNAP violation letter. Snap violation penalties can include fines and penalties. If it’s believed you did a major SNAP violation, then you may end up with a temporary or permanent disqualification. In many situations, store owners didn’t even know the violations were even occurring. In many situations, dishonest employees are misusing the SNAP EBT program.
