If you’re a retailer who accepts EBT at your retail store, then may have been the recipient of a a official notice from the USDA. The notification is most likely a SNAP violation letter, which is claiming you are in violation of the SNAP program. The government will include proof to the SNAP violation notice, and it will have transactions that occurred at your retail store which the government claims violates one or more groups of violations.

About The SNAP Program

This program provides families with get food each month. These benefits are given via an EBT card. The SNAP benefits on this card cannot legally be used for general usage, and they cannot be used for cash back transactions. The cards took the place of food stamps in the 1990’s and are issued in the state where the recipient lives. The SNAP program is run on a national level by the government.

This program and the benefits that come with it are under handled by the US Code and the Code of Federal Regulations. The USDA FNS agency enforces the regulations and runs the program.

What’s a SNAP Violation

SNAP legal violations happen if and when a grocery store is in violation of the following rules.

The retail store was involved inthe trafficking of SNAP benefits. This can mean fraudulently accepting taking the benefits, or stealing the benefits. Your grocery store took SNAP funds in exchange for nonfood items like alcohol, tobacco, or other goods. The store submitted incorrect information on the grocery stores application to accept EBT benefits. The grocery store took money for more coupons than sale of actual food during the same period. The employees of the store took SNAP benefits from someone who shouldn’t be allowed to use the benefits.

Defending against a SNAP Violation Letter

SNAP Violations

As a food store retailer, there’s a lot of rules and regulations you have to adhere to for EBT. In most cases, many grocery store owners have no problems adhering to them. However, USDA’s SNAP program can be tricky. SNAP handles the Electronic Benefits Transfer Card, and has limitations. For example, SNAP recipients cant purchase electronic goods. As a retailer, if you violate the laws, you’ll get a SNAP violation letter. Penalties of violating SNAP can result in fines, and penalties. If it’s believed you did a serious violation, then you might end up with a temporary or permanent disqualification. In most cases, store owners didn’t know SNAP violations are even happening. In many situations, dishonest employees who are misusing the SNAP EBT program. The USDA is required by Congress to issue a disqualification for a period of up to 5 years. This can result in huge losses which are hard to recover from.
