If you accept EBT at your grocery store, then it’s possible have been the recipient of a a official notice from the USDA. The notice is probably a SNAP violation notice, which is alleging you violated the SNAP program. The government will attach a number of pages to the SNAP violation letter, which will contain records of transactions which occurred at your store which the government is saying violates one or more groups of violations.

After you get a SNAP violation notice, you should definitely contact our legal team. Remember, you have only ten days to respond to the letter. If you choose to ignore, the government will suspend your grocery store’s ability to accept EBT payments.

About The SNAP Program

This program helps families with funds to buy food each month. The SNAP program benefits are given with an EBT card. The benefits on this card cannot be used for general use, and they can’t be used for cash back services. The EBT cards took over for food stamps in the 1990’s and the card is issued by each state individually which the SNAP participant lives. This program is run on a national level by the government.

The federal and it’s parameters are governed by the United States Code and the Code of Federal Regulations. The USDA FNS agency enforces the regulations and runs the program.

What does it mean to have a SNAP violation

Snap violations occur if and when a grocery store is in violation of the rules below.

The retail store is accused oftrafficking SNAP benefits. Examples of this is fraudulently accepting taking the benefits, or stealing the benefits. The grocery store accepted SNAP funds in exchange for nonfood items like alcohol, tobacco, or other goods. Your store submitted incorrect information on the store’s application to accept EBT benefits. The store redeemed more EBT food stamps than sale of actual food during the same period. Your employees have taken SNAP benefits from someone who isn’t allowed to use them.

Defending against a SNAP Violation Letter

Spodek Law Group has immense experience managing SNAP violations letters. Our law firm can handle your SNAP violation process in all 3 phases of a SNAP Violation action.

Sending the violation letter is the initial step which is going to be taken by USDA to take away your EBT license. The letter can come with no warning and can appear at any time. The SNAP violation letter will have allegations in it, but most of them will mention serious allegations, and have attached documents detailing the violations. You have only 10 days to respond. Once you hire our law firm, we handle all of the communicationswith the USDA and for compiling all the necessary evidence, and drafting a response to the USDA.

Once the USDA reviews your answer to the SNAP violation letter, the USDA may still believe that a violation has occurred. If this happens, they’ll will 100% issue a second letter which outlines the agencies decision to suspend or disqualify the retail store based on the allegations set forth. You have 10 days to appeal this. If you don’t, then you’ll be stuck with the USDA decision. Once you hire our firm, we’ll file the necessary paperwork and notify the USDA appeal the decision. Our lawyers gather necessary evidence, and our team will draft the necessary appeals briefs which contains all of the legal laws, legal evidence, etc. which is critical to change the outcome of the violations.

In the event the USDA refuses to override the legal decision, in the Administrative Review, we will file a Judicial review at the local Federal District Court. This next phase is like a normal court case, where you’ll be able to do discovery, file motions, and have a trial. Our attorneys can handle these cases in all 50 states.

SNAP Violations

As a grocery store retailer, there are many laws have to obey in order to accept EBT. In most normal situations, many grocery store owners have no problems adhering to them. However, the SNAP program can be tricky. SNAP handles the Electronic Benefits Transfer Card, and has limits on how the funds can be used. For example, SNAP recipients cant get electronic goods. If you violate the laws, you’ll get a SNAP violation letter. Snap violation penalties can include fines and penalties. If you conduct a serious violation, then you may end up with a temporary or permanent disqualification. In most cases, store owners didn’t even know the violations were even occurring. Often, it’s dishonest employees who are misusing the SNAP program. It’s helpful to discuss your case with a SNAP violation lawyer to make sure you don’t have your benefits revoked.

When a SNAP violation letter is sent to your grocery store, you only have ten days to respond to the allegations. Your failure to respond to the violations will permanently harm your store. In addition, the USDA will make a verdict even though you don’t respond to the allegations. Without legal experience, you won’t be able to retain EBT benefits. Retaining a SNAP violation lawyer gives you a fighting change. Our SNAP appeals lawyers will discredit the decision of the USDA and appeal any decision. The penalties imposed can expensive - to the tune of ten’s of thousands of dollars. The USDA on purpose imposes huge fines to in order to curb future violations. The USDA will typically look to see if you have a compliance policy in place. It has to be in writing and the policy must be when the allegations were filed.

The grocery store must be able to prove the compliance policy was in existence before the allegations, and was not drafted after the violation letter. The USDA typically also looks to see if the grocery store owners benefited in any way from the fraud, or if the business owners were aware of the fraud. If the managers were involved, it can lead to disqualification.

It’s highly recommended any owner that gets a allegation letter consult with a SNAP violation attorney. Failure can result in negative consequences. The USDA is required by Congress to issue a disqualification for a period of up to 5 years. This can result in huge losses which are hard to recover from.
