SNAP violation defense in Oklahoma: who decides, what they see, and what to file

A charge letter is USDA work, start to finish. In Oklahoma the Department of Human Services runs SNAP for households, but retailer sanctions belong to USDA’s Food and Nutrition Service, whose Southwest Region operates out of Dallas. That distinction matters on day one, because owners lose time calling the wrong agency. Ten days from receipt, under 7 CFR 278.6(b)(1), and FNS doesn’t extend it.

Tribal jurisdictions and rural counties mean many stores are the only food retail for a wide radius. Tribal-land and rural stores produce redemption patterns that have nothing in common with the stores ALERT chooses as peers. These cases typically begin as an anomaly report out of the ALERT system. The comparison set is the weakness: it’s built from stores the model thinks resemble yours.

Trafficking carries permanent disqualification as its default under 278.6(e)(1). The regulation reaches conduct by personnel of the firm, so a clerk’s act is attributed to the store and the owner’s knowledge isn’t a defense to the finding. What keeps a store open is a written request for a civil money penalty in lieu, filed in that same window. Where the request is untimely, 278.6(b)(2)(iii) forecloses the penalty forever.

What actually moves a Oklahoma case is documentary. Purchase records, itemized baskets and inventory are the rebuttal. Where the charge is a pattern of ineligible items rather than trafficking, the sanction is a term on the ladder at 7 CFR 278.6(e) - six months to five years - and proportion, itemized baskets and a documented compliance program are what pull it down a rung.

Administrative review under 7 CFR 279 follows, and it’s the last stage where documents can be added. 7 U.S.C. 2023 gives thirty days to file in district court, where review is de novo. For Oklahoma retailers that means the Northern, Eastern and Western Districts of Oklahoma, and it means the review record you build now is the record a judge reads later.
